Spousal support and alimony

While child support is based generally on a computerized formula, there is no set formula for determining the amount or duration of alimony or spousal support. Instead, there are certain statutory factors that will affect an award of alimony such as the length of the marriage, and the age, health, and income of the spouses.

Types of alimony:

  • Rehabilitative: Allows a spouse to go to school, get training, and increase their ability to earn a living.
  • Reimbursement: Is provided in some cases wherein a spouse supported another spouse while in college, medical school, law school, etc.
  • Limited-duration: Is payable for a specific period of time. For example, you may be entitled to limited-duration alimony for 5 years.
  • Permanent alimony: Payable until death of either spouse or the remarriage of recipient. Permanent alimony is subject to modification or termination due to substantial changes of circumstances such as retirement, cohabitation, disability, job loss, etc.
  • Tevis claims: Payable as compensation when one spouse severely injures another in an assault or another tort.
